1. Purpose and scope
New York restricts unlicensed insurance producer activity. Appointment duties depend on the role and insurer relationship under section 2112. Other states and lines of authority need their own validation.
Identify the legal entity, producer role and lines of authority. Confirm exemptions and appointment requirements; a software supplier is not automatically a producer.
2. Adoption and accountability
The accountable policy owner must confirm the legal entity, products, customer locations, applicable laws and exemptions before adoption. Maintain an applicability register and obtain management approval of procedures, owners, retention and deadlines. This template does not claim legal review or complete compliance coverage. An industry selection is a suggestion, not evidence of a legal duty.
3. Operating controls
3.1 Verify authority before distribution
Owner: Distribution compliance lead. Trigger: Before a producer starts a new role, product line or state.
Check the person and business entity against the state licensing record, approved line and authorized activity. Block activity outside that authority until an authorized compliance reviewer resolves it.
Evidence: License verification and approved activity matrix.
3.2 Control insurer appointments
Owner: Licensing manager. Trigger: When establishing, changing or ending an insurer–producer relationship.
Determine whether an appointment is required for this role. Track the applicable filing and termination requirements, evidence submission, and reconcile the insurer roster to permitted activity.
Evidence: Appointment decision and filing receipts.
3.3 Track renewals and qualification changes
Owner: Licensing manager. Trigger: Before license expiry and when a qualification or disciplinary status changes.
Maintain renewal and education dates from the controlling state rules. Escalate lapses, restrict affected activity and document restoration only after verification.
Evidence: License calendar and exception record.
3.4 Review outsourced distribution
Owner: Distribution compliance lead. Trigger: At onboarding and the company’s annual distribution review.
Sample intermediaries, websites and referral arrangements for activity beyond approved authority. Update contracts and supervision, and close corrective actions. The review interval is a company control.
Evidence: Distribution review and remediation evidence.
4. Exceptions, review and records
Log deviations with the affected control, risk, interim action, owner and resolution date. Escalate missed statutory duties immediately to the responsible compliance lead; internal exceptions cannot waive law. Keep versioned approvals and follow the confirmed retention schedule and any legal hold. Review after material legal, product or operating changes.
